Lawmakers have developed a new bill concerning the medical information of conscripts. The guarantees of medical confidentiality for the results of medical examinations aimed at determining the fitness of conscripts, military personnel, and reservists will effectively be removed—this information will be automatically transmitted to the "Oberih" Registry. The corresponding draft law No. 12066 has been registered in the Verkhovna Rada by a group of deputies led by Oleksandr Zavitnevych and Oleksandr Fedienko from the "Servant of the People" party.
The amendments to the Law on the "Fundamentals of Ukrainian Legislation on Health Care" stipulate the removal of guarantees of medical confidentiality concerning the results of medical examinations of conscripts, military personnel, and reservists conducted to determine their fitness for military service.
The current law provides that the information exchange between the electronic health care system (EHS) and other registries must comply with the requirements of the Law on "Protection of Personal Data". It is important to note that during information exchange, access to a patient's medical information is prohibited. This is explicitly stipulated by law.
The new draft law proposes that the EHS will also automatically transmit data to the Unified State Register of Conscripts, Military Personnel, and Reservists "Oberih". Meanwhile, access to a patient's medical information will be allowed for the purpose of "obtaining information by the Ministry of Defense of Ukraine regarding the results of medical examinations of conscripts, military personnel, and reservists, conducted to determine fitness for military duty to be entered into the Unified State Register of Conscripts, Military Personnel, and Reservists to ensure national security and defense".
Additionally, modifications are being made to the law regarding the Register of Conscripts, Military Personnel, and Reservists, which stipulate that the Ministry of Health must transmit information about the results of medical examinations conducted to determine fitness for military duty to the "Oberih" Registry. The "Oberih" Registry will receive data via electronic interaction with the EHS.
