The National Security Committee recommends that the Ukrainian Parliament approve draft law №12066. This document provides for access to medical information about conscripts, military personnel, and reservists, as well as its incorporation into the "Oberih" registry.

In fact, a special exception will be added to Article 24-3 of the Law "On the Fundamentals of Health Legislation of Ukraine," which states that access to a patient's medical information is not permitted during information interactions. As a result, access to patient medical information during these interactions will be allowed for the Ministry of Defense of Ukraine to obtain data on the outcomes of medical examinations of conscripts, military personnel, and reservists conducted to assess their fitness for military service. This will facilitate their entry into the Unified State Register of Conscripts, Military Personnel, and Reservists "Oberih" to ensure national security and defense.

Thus, the electronic health system (EHS) will begin to automatically "share" data with the Unified State Register of Conscripts, Military Personnel, and Reservists "Oberih." Co-author of the draft law, Oleksandr Fedienko, explained that there will be little change for military personnel, as information after undergoing the military medical commission (MMC) is already entered into the "Oberih" system.

According to the co-author of draft law №12066, the proposed norm simply clarifies that the results will be transmitted from the EHS to the "Oberih" system immediately, rather than within a day.

He also added that currently, "Article 32 of the Constitution allows for deviations in processing confidential information about a person without consent—based on the law for national security purposes."

Earlier, Deputy Minister of Defense for Digitalization Yekaterina Chornogorenko noted that the Ministry of Defense has already prepared draft amendments to the legislation as part of the digitalization of the MMC, which will enable health information about military personnel to be transmitted from civilian healthcare facilities to the Ministry of Defense systems in a matter of minutes. This means not only from the MMC but also from regular private hospitals.
