The court ruled that the charges in the case were "imprecisely formulated" and sided with the IT specialist.
According to the materials of the case reviewed by the Velykyi Bereznyi District Court of the Zakarpattia region (via dev.ua), an IT specialist from EPAM was detained on August 28th on the outskirts of the village of Sol in the Uzhhorod district of Zakarpattia — 5.1 km from the state border with Slovakia — and was accused of attempting to illegally cross it.
The IT specialist did not attend the hearing but submitted a statement explaining his absence due to the "long distance to his place of residence." Furthermore, he stated that he arrived in Zakarpattia to visit several localities and tourist complexes, with plans to return to Lviv. He also emphasized that he did not intend to cross the border and did not carry either a passport or currency.
Notably, the programmer mentioned that he was detained in the village of Poroshkovo, not in the village of Sol. As evidence, he provided the court with copies of an order from the Ministry of Economy regarding reservation, a leave order dated August 26, 2024, a military registration document from the "Reserve+" system, and receipts for various payments.
In its ruling, the court stated that the protocol drawn up against the EPAM IT specialist did not specify "the exact nature of the offense and what actions he took for it" and that the overall text was "imprecisely formulated." There was also no evidence that the man was detained specifically while attempting to cross the border and exactly on the outskirts of the village of Sol.
“The programmer's presence in the controlled border area, without providing proper and permissible evidence, cannot indicate that he attempted to illegally cross the state border of Ukraine,” the ruling states.
The court decided to close the proceedings due to the absence of an administrative offense committed by the programmer.
